GENERAL PROVISIONS
§ 70.01 DUTY TO OBEY POLICE OFFICER.
(A) At each street intersection where there is now, or may hereafter be stationed by order of the Common Council, any traffic officer or silent policeman, the traffic shall stop, move or turn at the time and in the manner only as indicated by the traffic officer or silent policeman. (B) SILENT POLICEMAN shall mean any suitable device, post standard or sign, placed within any street or along the side as a warning, or for the control or direction of traffic. (`84 Code, § 8-22)

INSPECTIONS
§ 70.10 POLICE INSPECTION FOR CERTIFICATE OF TITLE.
Pursuant to I.C. 9-29-4-2, officers of the Police Department are authorized to inspect motor vehicles, semi-trailers or recreational vehicles to verify the facts set forth in applications for certificate of title for those vehicles.

§ 70.11 FEES.
(A) The Police Department is hereby authorized, pursuant to I.C. 9-29-4-2, to charge a fee in the sum of $5 for each vehicle inspected. The fee shall be charged to the owner of the vehicle or vehicles for the inspection verification of the facts set forth in the application for a certificate of title for the vehicle or vehicles.
(B) The police officer making the inspection is authorized to collect the fee and shall remit all fees daily to the Chief of Police or his/her duly authorized representative. The Chief of Police or his/her duly authorized representative shall remit the fees at least monthly to the Clerk-Treasurer.
(C) A receipt for the certificate of title inspection fee shall be given to the owner paying the fee with a duplicate copy of the form retained by the Police Department.

§ 70.12 DEPOSIT OF FEES.
The Police Department certificate of title fees shall be deposited by the Clerk-Treasurer in the Police Department Special Vehicles Inspection Fund. All moneys collected from the inspections shall be appropriated only for law enforcement purposes.

MOVING STRUCTURES OVER CITY STREETS
§ 70.25 PERMIT REQUIRED.
It shall be unlawful for any person, firm, or corporation to move or cause to be moved any house, barn or other building over the streets of the city without first obtaining a written permit from the Board of Public Works and Safety.

§ 70.26 BOND REQUIRED.
As a condition to obtaining a permit and prior to any moving, the owner of the building, or the contractor, shall post a bond in the sum of $1,000, which bond shall be available to pay any damages to streets or other property of the city for any liability of the city arising out of the moving. The surety on the bond shall be acceptable to the Board of Public Works and Safety.

§ 70.27 EQUIPMENT REQUIRED.
The equipment used in moving a building shall have rubber-tired wheels and meet any other specifications as may be furnished to the owner or mover by the Board of Public Works and Safety.

BICYCLES
§ 70.40 DEFINITION.
A BICYCLE shall be defined as any foot- propelled vehicle, irrespective of the number of wheels it has in contact with the ground.

§ 70.41 CONFORMANCE WITH STATE LAW.
Operators of bicycles, when on a public street, road, or highway within the city, shall conform to the rules and regulations established for the operation of motor vehicles.

§ 70.42 OBEDIENCE TO TRAFFIC CONTROL DEVICES.
Operators of bicycles shall obey the directions and instructions of official traffic control devices and signals applicable to vehicles, unless otherwise directed by a police officer.

LEHMAN PARK RESTRICTIONS
§ 70.55 PARKING AND WEIGHT RESTRICTIONS.
(A) It shall be unlawful for any person, firm, or corporation to allow or cause a motor vehicle, tractor, trailer, or semi-trailer of a capacity in excess of 16,000 pounds except as necessary for pick-up, delivery or service for Lehman Park or the persons using Lehman Park.
(B) It shall be unlawful to operate, park, or cause to stand, any motor truck, tractor, trailer, or semi-trailer in Lehman Park, or on the streets and/or parking areas adjacent to Lehman Park, of a weight capacity of less than 16,000 pounds, except as necessary for pick-up, delivery or service for Lehman Park or the persons using Lehman Park.

§ 71.01 STOP SIGNS.
(A) Street signs designating the stop intersections described in Chapter 73, Schedule II, shall have stop signs placed, which shall be erected at the entrance to the intersections and each intersection shall be so marked.
(B) The driver approaching the stop signs designated in Chapter 73, Schedule II, shall come to a complete stop as required by state law before proceeding through the intersection.

§ 71.02 YIELD SIGNS.
(A) Street signs designating intersections notifying vehicles to “Yield Right of Way” shall be erected at one or more entrances to any of the streets designated in Chapter 73, Schedule III, and each intersection shall be so marked.
(B) The driver of a vehicle approaching a “Yield Right of Way” sign shall, in obedience to the sign, slow down to a speed reasonable for the existing conditions, or shall stop if necessary, and shall yield the right-of-way to any pedestrian legally crossing the roadway on which he is driving, and to any vehicle in the intersection or approaching on another street so closely as to constitute an immediate hazard. The driver so to yielded may proceed and the drivers of all other vehicles approaching the intersection shall yield to the vehicle so proceeding, provided however, that if the driver is involved in a collision with a pedestrian in a crosswalk or a vehicle in the intersection after driving past a Yield Right-of-Way sign without stopping, the collision shall be deemed prima facie evidence of his failure to yield right of way.

§ 71.03 JAKE BRAKING.
(A) No person shall drive or operate a vehicle exceeding 5,000 pounds in gross weight within the corporate limits of the city using engine compression brakes or an engine retarder system to stop or slow down the vehicle if the system causes the vehicle's motor to race in such a manner as to cause the exhaust system to emit a loud, cracking, backfiring, or chattering noise unusual to its normal operation. The practice is sometimes commonly known as “jake braking."
(B) The prohibition shall be designated by appropriate signs placed at or near the city limits on U.S. Highway 27 and State Road 218 (I.C. 9-20-1-3(C)(2)).

GENERAL PROVISIONS
§ 72.01 DEFINITIONS.
For the purpose of this chapter, the following definitions shall apply, unless the context clearly indicates or requires a different meaning.
DRIVER. Every person who drives or is in actual physical control of a vehicle.
OPERATOR. Shall include the driver or rider of any vehicle.
PARKING. The placing, allowing, or permitting or stopping any vehicle within any street or public place for any purpose other than for the unloading or loading of freight, goods, wares or merchandise, which loading or unloading shall not in any event exceed 15 minutes.
VEHICLE. Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moving by human power.

§ 72.02 PARKING LOCATION REGULATIONS.
It is declared unlawful and a violation of this section for any person, firm or corporation to park or allow his motor vehicle to stand upon the following streets contrary to the following prescribed manner:
(A) Parking on Hendricks Street, from Main Street to Franklin Street shall be only parallel to the curb.
(B) Parking on Jefferson Street from Water Street to Franklin Street shall be only parallel to the curb.
(C) Parking on Sprunger Street, from Main Street to Water Street, shall be parallel with the curb on the west side of Sprunger Street, and shall be at an angle to the curb on the east side of Sprunger Street.

(D) Parking shall be parallel with the curb only on Sprunger Street from Main Street to Water Street. (`84 Code, § 8-23)

§ 72.03 GENERAL PARKING RESTRICTION.
It shall be unlawful to park any vehicle on or along any preferential streets except at the places and in the position as may be indicated by proper lines or silent policeman on the streets, and in no event shall any vehicle be so parked upon any streets so as to use or occupy more than 15 feet in width of the street. § 72.04 PARKING PROHIBITED IN CERTAIN AREAS.
(A) No person shall stop, stand, or park a vehicle, except when necessary to avoid conflict with other traffic or to avoid conflict with law or the directions of a police officer or traffic control device, in any of the following places:
(1) On a sidewalk.
(2) In front of a public or private driveway.
(3) Within an intersection.
(4) Within 15 feet of a fire hydrant.
(5) On a crosswalk.
(6) Within 20 feet of a crosswalk at an intersection.
(7) Within 30 feet upon the approach to any flashing beacon, stop sign, or traffic control signal located at the side of a roadway.
(8) Between a safety zone and the adjacent curb or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless the traffic authority indicates a different length by signs or markings.
(9) Within 50 feet of the nearest rail of a railroad crossing.
(10) Within 20 feet of the driveway entrance to any fire station and, on the side of the street opposite the entrance to any fire station, within 75 feet of the entrance when properly sign-posted.
(11) Alongside or opposite any street excavation or obstruction when stopping, standing, or parking would obstruct traffic.
(12) On the roadway side of any vehicle stopped or parked at the edge or curb of a street.
(13) Upon any bridge or other elevated structure upon a highway, or within a highway tunnel.
(14) At any place where official signs prohibit stopping.
(B) No person shall move a vehicle not owned by that person into any prohibited area or away from a curb a distance as is unlawful.

PARKING AND ASSEMBLIES ON WALKWAYS, DRIVEWAYS AND PARKING AREAS
§ 72.15 BLOCKING ENTRANCE TO PARKING AREA PROHIBITED.
It shall be unlawful for any person to intentionally block entrances or exits to any parking area adjacent to any business building in any manner unless by direction of the owner or manager of the public, business or church building, whereby doing so causes any difficulty in entering or exiting the premises or adjacent drive or parking area, except for the purpose of repairs by municipal authorities or private contractors engaged by owners.

§ 72.16 DRIVING THROUGH PARKING AREAS PROHIBITED.
It shall be unlawful for any person to drive a motor vehicle through any parking area or driveways of any public, business or church building without attempting to park the vehicle.

§ 72.17 ADDITIONAL PROHIBITIONS.
(A) It shall be unlawful for any person to leave an unoccupied motor vehicle upon a walkway, driveway or parking area of a public building, business building, or church building and leave the premises to go elsewhere without the knowledge and consent of the owner, manager or person in charge of the premises, if the premises are so posted by the owner or manager.
(B) It shall be unlawful for any person to enter upon a walkway, driveway or parking area of a public building, business building, or church building unless the individual entering the premises does so for the purpose of conducting business or does so with the knowledge and consent of the owner, manager or person in charge of the premises, if the premises are so posted by the owner or manager.

§ 72.18 SIGNS REQUIRED.
(A) To come under the provisions of this subchapter, the owner or manager of public, business or church premises shall be required to post notices in a conspicuous location, by one or more signs displaying the fact that the premises are protected by the terms of this subchapter.
(B) It shall be unlawful for anyone, other than the owner or one designated by the owner, to remove, deface or tamper with a sign posting notice pursuant to this subchapter.

§ 72.19 AGREEMENT WITH CITY.
(A) It shall be the duty of the owner or manager of the public, business and church premises to sign an agreement with the Board of Public Works and Safety that the owner or manager shall post notices as described in this subchapter, and that the owner or manager shall cooperate to prosecute any person charged with violation of this subchapter.
(B) After the above agreement is filed, the city shall design and furnish, for a fee determined by the Board of Public Works and Safety, a notice to the owner or owners to be posted.
(C) The above agreement must be signed and filed in the office of the Clerk-Treasurer, and notice must have been posted in conspicuous places on the property intended to be covered by this subchapter.

HANDICAPPED PARKING
§ 72.30 REGULATION OF HANDICAPPED SPACES.
(A) Definition. As used in this subchapter, PHYSICALLY HANDICAPPED PERSON means a person who has been issued a placard from the Indiana Rehabilitation Services Agency under I.C. 9-14-5, or a handicapped registration plate for a motor vehicle by the Bureau of Motor Vehicles under I.C. 9-18-22.
(B) Posting of signs. A sign shall be posted immediately adjacent to and visible from any handicapped space, bearing the official International Wheelchair Symbol or a reasonable facsimile of that symbol.

§ 72.31 VIOLATIONS.
(A) It is unlawful for any person to park a motor vehicle which does not have displayed a handicapped person's placard issued from the Indiana Rehabilitation Services Agency or handicapped registration plate issued under I.C. 9-18-22 in a parking space reserved under this subchapter for a handicapped person's vehicle.
(B) It is unlawful for any person to knowingly park in a reserved handicapped parking space while displaying a placard to which neither he nor his passenger is entitled.
(C) It is unlawful for any person to display for use in parking in a reserved handicapped parking space a placard or a special license plate not issued under I.C. 9-14-5 or under I.C. 9-7-4.1.

§ 72.32 TOWING OF VEHICLES.
The Police Department is authorized to remove and tow away, or have removed and towed away by commercial towing service, any car or other vehicle illegally parked in any place reserved and designated as a physically handicapped parking space which does not display a handicapped person's placard or handicapped registration plate. Vehicles so towed away for illegal parking shall be stored in a safe place and shall be restored to the owner or operator of the car upon payment of all towing and storage costs.

TRUCKS, TRAILERS AND TRUCK CABS
§ 72.40 PARKING OF TRUCKS, TRAILERS, AND TRUCK CABS.
(A) It shall be unlawful for any person to park a truck or truck cab which is 20 feet or more in overall length or 8 feet or more in overall width, on any public way in the city which is in front of any dwelling house, apartment house, or other place of residence in the city, or which is in any residentially zoned district within the city, either in the daytime or nighttime, unless while actually engaged in the loading and unloading of freight, merchandise or other material on or from the vehicle.
(B) It shall be unlawful for any person to park a trailer of any size or type on any public way in the city except:
(1) Temporarily, not to exceed two hours, in any 24-hour period; or
(2) While actually engaged in loading or unloading freight or other material on or from the vehicle; or
(3) Within an industrial area or in a designated parking area.

§ 72.99 PENALTY.
(A) Any person, firm, or corporation who violates any provision of this chapter for which another penalty is not specifically provided shall, upon conviction, be subject to a fine not exceeding $2,500. A separate offense shall be deemed committed upon each day during which a violation occurs or continues.
(B) Any person, whether a driver, operator, or owner of any truck, truck cab or trailer mentioned in § 72.40, who violates the provisions of § 72.40, shall be fined $100. Each violation within a 24-hour period shall be deemed a separate offense.
(C) Any truck, truck cab or trailer in violation of § 72.40, after 48 hours of notification to the driver, operator or owner, shall be towed by the city, at the expense of the violator, which towing expense shall not exceed $500.
(D) Storage charges to be charged to the violator for any vehicle impounded pursuant to § 72.40(B) shall be a rate of $25 per day.

Pursuant to I.C. 9-21-5-6, the city has determined, on the basis of engineering and traffic investigations, that the reasonable and safe maximum speed limit is as indicated on the following designated streets. SCHEDULE V. THROUGH TRUCKS PROHIBITED.
It shall be unlawful for any truck, van or other motor vehicle exceeding 5,000 pounds in gross weight and a height exceeding 13 feet to use, for the purpose of travel, the streets indicated. Provided, however, that the vehicles may be operated thereon for the purpose of delivering or picking up materials or merchandise to dwellings located along either side of the street, and then only for the purpose of loading or unloading merchandise or freight at those places, and then only by entering the street at the intersection nearest the destination of the vehicle and proceeding thereon no further than the nearest intersection thereafter. Appropriate street signs shall be placed which shall be erected by the Street Department to the end that the restrictions are clearly designated.

SCHEDULE II. LIMITED PARKING.
(A) It shall be unlawful for any person, firm, or corporation to park or allow a vehicle to remain in excess of the time limitation indicated, except Sundays and holidays, between the hours of 6:00 a.m. and 6:00 p.m.
(B) On the streets indicated, live parking only, only live parking, shall be permitted at all times. LIVE PARKING shall be defined as parking with the driver remaining in his or her vehicle or physically attending his or her vehicle.
(C) It shall be unlawful for any person to park or allow any vehicle to remain for a longer consecutive period of time than that designated in the area designated as a limited parking area. SCHOOL DAY shall be defined as any day when South Adams Schools are in session, including summer school sessions. VEHICLE shall be defined as every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moving by human power.

SCHEDULE IV. LOADING ZONES.
(A) Definitions. For the purpose of this schedule, the following definitions shall apply unless the context clearly indicates or requires a different meaning
DRIVER. Every person who drives or is in actual physical control of a vehicle.
LIVE PARKING. Parking with the driver remaining in his or her vehicle or physically attending his or her vehicle.
PASSENGER LOADING ZONE. The space adjacent to the curb reserved for the exclusive use of vehicles during the loading or unloading of passengers.
VEHICLE. Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moving by human power.
