	TO DISPOSE BY SALE OF PERSONAL PROPERTY OF CITY OF

	PURSUANT TO I.C. 5&#45;22&#45;22&#45;5
	Notice is hereby given that the Common Council of the City of Berne
	intends to dispose by sale of the following described personal property
	pursuant to I.C. 5&#45;22&#45;22&#45;5 which is no longer needed. The property is
	described as follows:
	Lehman Park playground equipment currently located west of the main
	swings in Lehman Park, Berne, Indiana consisting of a steel structure,
	wooden composite and steel trolley unit.
	Sealed bids must be received by the City of Berne c/o Clerk Treasurer, City
	Hall, Berne, Indiana by 4:00 p.m. on Thursday, March 14, 2013. The sale
	will be made to the highest responsible bidder.
	All bids shall be for the entire structure as advertised and no bids shall be
	accepted for any part or portion of the equipment.
	The property may not be sold to a person who is ineligible under I.C.
	36&#45;1&#45;11&#45;16 and an offer to purchase the property submitted by a trust (as
	defined in I.C. 30&#45;4&#45;1&#45;1(a)) must identify each beneficiary of the trust and
	settlor empowered to revoke or modify the trust.
	The highest responsible bidder shall be required to execute a contract with
	the City of Berne to completely remove the park equipment from Lehman
	Park, at bidder&amp;rsquo;s sole cost and expense, on or before March 25, 2013.
	The City of Berne reserves the right to reject all bids.
